These Terms of Service ("Terms") constitute a legally binding agreement between you and Globetrix Tours ("Globetrix Tours," "we," "our," or "us"), governing your use of our website, booking platform, travel services, and all related offerings. By accessing our services or completing a booking, you confirm that you have read, understood, and agreed to be bound by these Terms in their entirety.
Definitions and Scope of Agreement
Throughout these Terms, the following definitions apply: "Services" refers to all travel packages, tours, itineraries, bookings, consultations, and ancillary offerings provided by Globetrix Tours. "Client" or "Traveler" refers to any individual or group that purchases, books, or inquires about our Services. "Tour Package" means any bundled combination of transportation, accommodation, guided experiences, and related components sold or arranged by us.
These Terms apply to all transactions conducted through our website, by telephone, via email correspondence, or through any authorized third-party booking agent acting on our behalf. Your agreement to these Terms is a prerequisite to receiving our Services, and continued use of our platform constitutes ongoing acceptance.
We reserve the right to update or modify these Terms at any time. Clients will be notified of material changes via email or prominent notice on our website. Continued use of our Services following notification constitutes acceptance of the revised Terms.
Booking Process and Confirmation
All bookings must be initiated through an authorized channel — our website, direct email, or telephone consultation with a Globetrix Tours specialist. A booking is not confirmed until Globetrix Tours issues a written Booking Confirmation and receives the required deposit or full payment as specified in the booking agreement.
The Booking Confirmation will detail: the specific tour package, departure and return dates, destination(s), number of travelers, included services, total cost, payment schedule, and any applicable conditions or restrictions. Clients are responsible for reviewing this confirmation and notifying us of any discrepancies within 48 hours of receipt.
- A non-refundable deposit of 25% of the total package price is required to secure a booking.
- Full payment is due no later than 60 days prior to the scheduled departure date.
- Bookings made within 60 days of departure require full payment at time of booking.
- All prices are quoted in United States Dollars (USD) unless otherwise stated.
- Prices are subject to change until a Booking Confirmation is issued and deposit received.
Globetrix Tours reserves the right to decline any booking at its sole discretion without providing reason, in which case any payments received will be refunded in full within 10 business days.
Travel Documents and Client Responsibilities
Clients are solely responsible for ensuring they possess all required travel documentation prior to departure. This includes, but is not limited to, valid passports (with a minimum of six months' validity beyond the return date), appropriate visas, entry permits, health certificates, and any other documentation required by the destination country.
Globetrix Tours provides general guidance on documentation requirements as a courtesy only and cannot be held liable for any loss, expense, or consequence arising from a client's failure to obtain or maintain proper documentation. It is the client's responsibility to verify requirements with the relevant embassies and consular offices.
- Passports: Must be valid for at least 6 months beyond your scheduled return date.
- Japan Visas: Citizens of many countries enjoy visa-free access to Japan for up to 90 days. Clients must independently verify their specific entry requirements.
- Travel Insurance: Strongly recommended. Globetrix Tours is not responsible for medical, evacuation, or trip interruption costs not covered by insurance.
- Health Requirements: Clients must comply with all destination-country health regulations including vaccinations, testing, or entry questionnaires.
- Name Accuracy: All names on bookings must exactly match the traveler's passport. Errors may result in additional fees or inability to travel.
Itinerary Changes and Force Majeure
While Globetrix Tours takes every precaution to deliver the experience as described, we reserve the right to modify itineraries when necessary due to circumstances beyond our reasonable control. Such circumstances include, but are not limited to, severe weather, natural disasters, government travel advisories, political unrest, strikes, supplier failures, pandemics, or other force majeure events.
In the event of a significant itinerary change prior to departure, Globetrix Tours will notify the client as promptly as possible and offer one of the following options: (a) acceptance of the modified itinerary, (b) an alternative tour of comparable value, or (c) cancellation with a refund in accordance with our Refund Policy.
Globetrix Tours shall not be liable for any costs, losses, or damages arising from force majeure events, including but not limited to: additional accommodation costs, transportation expenses, missed activities, or business losses. We strongly advise all clients to obtain comprehensive travel insurance that covers trip cancellations, interruptions, and delays.
Health, Safety, and Client Fitness
Clients are responsible for ensuring they are physically, mentally, and medically fit to participate in their selected tour. Certain tours involve significant walking, hiking, or physically demanding activities. Tour descriptions specify fitness requirements, and it is the client's responsibility to assess their own suitability.
Clients with pre-existing medical conditions, disabilities, or special requirements must disclose these at the time of booking. Globetrix Tours will make reasonable efforts to accommodate special needs; however, we cannot guarantee that all accommodations or activities will be accessible to all individuals.
- Clients must inform us of any dietary restrictions, allergies, or medical requirements before departure.
- Globetrix Tours and its guides have the right to exclude any client from activities deemed unsafe for that individual.
- Clients who become ill during a tour and require evacuation or hospitalization are responsible for all associated costs.
- We reserve the right to require a medical certificate of fitness for tours categorized as "Active" or "Adventure."
Conduct and Group Behavior
All clients are expected to behave in a respectful, lawful, and considerate manner toward fellow travelers, local guides, accommodation staff, and the communities we visit. Japan has specific cultural norms around respectful behavior in temples, shrines, public spaces, and with local residents. Globetrix Tours expects all clients to honor and observe these customs.
Globetrix Tours reserves the right, through its guides or representatives, to remove any client from a tour who: engages in abusive, threatening, or violent behavior; is under the influence of alcohol or drugs in a manner that affects the group; demonstrates willful disregard for cultural norms or local laws; or whose behavior creates safety risks for others.
In such cases, the client will be removed from the tour without refund and will bear all costs associated with their return travel. Globetrix Tours accepts no liability for expenses, losses, or inconveniences arising from such removal.
Intellectual Property and Photography
All content on the Globetrix Tours website and marketing materials, including text, images, videos, logos, itineraries, and brand elements, is the exclusive property of Globetrix Tours and is protected by applicable copyright, trademark, and intellectual property laws.
Clients grant Globetrix Tours a non-exclusive, royalty-free license to use photographs or videos taken by our guides and photographers during tours for promotional purposes. Clients will be credited where reasonably practicable. Clients who do not wish their likeness to be used for marketing purposes must notify us in writing prior to the commencement of their tour.
Limitation of Liability
To the maximum extent permitted by applicable law, Globetrix Tours and its officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Services, including but not limited to: lost profits, loss of data, personal injury, property damage, or any other losses resulting from participation in our tours.
Our total cumulative liability for any claim arising from or related to these Terms or our Services shall not exceed the total amount paid by the client for the specific tour package giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud, personal injury caused by negligence, or any other liability that is mandatorily imposed by law.
Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
Prior to initiating formal legal proceedings, clients agree to contact Globetrix Tours in writing and allow 30 days for us to attempt to resolve the dispute through good-faith negotiation. If resolution is not achieved, disputes involving claims under $10,000 may be submitted to binding arbitration through the American Arbitration Association under its Consumer Arbitration Rules.
Entire Agreement and Severability
These Terms, together with our Privacy Policy, Refund Policy, and any executed Booking Confirmation, constitute the entire agreement between you and Globetrix Tours regarding your use of our Services and supersede all prior agreements, representations, or understandings, whether written or oral.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
No waiver by Globetrix Tours of any breach of these Terms shall be considered a waiver of any subsequent breach of the same or any other provision. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
